General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (hereinafter referred to as "GTC") of Golfers Paradise AG, Brunnmatt 14, 6330 Cham, (hereinafter referred to as "Golfers Paradise") apply to all orders placed via the online shop www.golfersparadise.ch (hereinafter referred to as "Online Shop") as well as contracts concluded with Golfers Paradise. 
Provisions or general conditions of the customer or third parties (hereinafter collectively referred to as "customers") that contradict these GTC are not valid. The GTC apply exclusively even if Golfers Paradise provides its services without reservation after becoming aware of differing provisions or general conditions.
Golfers Paradise reserves the right to make changes to these GTC at any time. The currently valid version of the GTC is published at www.golfersparadise.ch and is considered accepted by the customer from the date of publication.

 

2. Offer / Contract Conclusion

The offer, that is all information about goods and prices in the online shop, (hereinafter referred to as "offer") is exclusively aimed at customers residing in Switzerland and Liechtenstein. All information about the offer is non-binding for Golfers Paradise and does not constitute a legal proposal. Golfers Paradise reserves the right to change the offer at any time, that is to change the range and prices. Images in product catalogs, brochures, advertising, in the online shop, etc. are for illustration purposes only and are non-binding for Golfers Paradise.

By sending the goods order as part of the online shop's ordering process, the customer places a binding order that he can no longer change.Upon receipt of the customer's goods order via the online shop at Golfers Paradise, an automatic order confirmation with an order number is sent to the customer by email. This order confirmation by email does not constitute acceptance of the customer's binding order and no contract is concluded. A contract is only concluded upon delivery of the goods ordered by the customer to the customer. Until delivery to the customer, Golfers Paradise reserves the right to refuse, in whole or in part, and not to deliver goods orders, with or without reasons. In this case, the customer will be informed immediately and any consideration already received will be refunded by Golfers Paradise as quickly as possible. The status of a goods order can be tracked in the "My Account" section under "Orders".

The prices in the online shop are in Swiss Francs (CHF), include the applicable statutory value-added tax, and are plus any shipping costs. The respective price at the time of the order applies.

The minimum age for orders in the online shop is 18 years.

4.Delivery

The delivery of the goods is carried out by a carrier commissioned by Golfers Paradise to the address desired by the customer during the ordering process, exclusively within Switzerland and Liechtenstein.

Any shipping costs will be communicated during the ordering process. Special shipping conditions apply to individual product categories. This may result in additional shipping costs. The information provided by the online shop is decisive, whereby changes to costs, fees, shipping conditions are possible at any time.

The information on delivery times of goods within the ordering process in the online shop is non-binding and can be changed by Golfers Paradise at any time, even after receipt of the binding order from the customer or after dispatch of the automatic order confirmation by email.For orders placed on weekends, holidays or weekdays after 5:00 PM at Golfers Paradise, delivery within the delivery time specified during the ordering process cannot be guaranteed.

 

5. Payment / Retention of Title

The customer's payment is made by credit card, invoice, PayPal, PostFinance or TWINT.

For each payment method, except for invoice, the order amount is charged immediately and in the event of a possible return (see below "Return or Right of Withdrawal") is relieved after the arrival of the goods at Golfers Paradise.

Purchase on account is processed by CembraPay AG. The terms and conditions and the privacy policy of CembraPay AG apply.

The goods delivered remain the property of Golfers Paradise until the invoice amount has been fully paid by the customer. Golfers Paradise is entitled to have the reservation registered in the reservation of ownership register.

 

6. Gift Vouchers

Gift vouchers are issued in paper form as well as digitally as a PDF document by email and can only be used for the purchase of Golfers Paradise goods and not for the purchase of further gift vouchers. Any discount promotions do not apply to the purchase of gift vouchers. The value of a gift voucher (total amount or remaining balance) is not paid out in cash and does not accrue interest.

Store redemption: To fully or partially pay for goods in a store, the gift voucher (physical form) must be presented on site. The corresponding amount will be deducted from the balance of the gift voucher.If payment is not possible due to a technical malfunction, Golfers Paradise reserves the right to reject the payment with the gift voucher in individual cases.

Any remaining balance of a gift voucher, when used in a store, is printed on the respective cash receipt. In case of loss, theft or damage of a gift voucher, Golfers Paradise assumes no liability. No replacement will be provided for lost or damaged gift vouchers.

The terms and conditions of the respective sales channel (online shop or store) apply to goods or services paid for with a gift voucher.

 

7. Notice of Defects / Warranty

The customer must immediately check the ordered goods for any defects after their delivery by the carrier.Complaints about defects must be made immediately, but no later than 14 days after delivery of the goods, by the customer to both the carrier and Golfers Paradise. Defects that were not apparent during the customer's immediate proper inspection (hidden defects) must be reported immediately after their discovery to both the carrier and Golfers Paradise.

Golfers Paradise provides a warranty for the defect-free condition of the ordered goods for a period of 2 years. The 2-year period begins with the shipment of the ordered goods to the customer. During this time, all defects that are subject to the warranty will be corrected free of charge, provided the customer reports the defect in a timely manner.The customer's warranty claims are limited to replacement delivery or defect rectification, excluding all possible other claims, in particular any compensation for direct (immediate) or indirect (mediate) damages. Golfers Paradise decides at its own discretion on replacement delivery or defect rectification. The warranty claim expires for damages due to improper handling and use of the goods.

In the event of an error in the price announcement or the product descriptions, Golfers Paradise is not bound by the incorrect information.

 

8. Return or Right of Withdrawal

The customer can revoke his order of goods without giving reasons by returning the ordered goods. The revocation by return must be made at the latest within 30 days of delivery of the goods to the customer.Excluded from the right of return are used goods, personalized items, and gift vouchers. The customer has the following options to assert the right of return or withdrawal.

8.1. Return in a branch / Online Shop
Golfers Paradise only accepts intact, unworn, and complete goods in the original packaging with the accompanying return slip.

Please note:
The goods must be returned in the original packaging.
Unstamped packages will not be accepted by Golfers Paradise and will be returned to the sender at the sender's expense.
The date of dispatch is decisive for compliance with the deadline.

The return is at the cost and risk of the customer.

In case of complaints or discrepancies, Golfers Paradise is available via contact form .

The refund of the value of the goods will be made upon return to Golfers Paradise at the latest, within 30 days of receipt of the goods at Golfers Paradise.

Any shipping and payment costs will not be refunded in the event of a return.

 

9. Loyalty Program

Golfers Paradise may offer the customer bonus programs. The applicable member conditions apply to any bonus programs.

 

10. Data Protection

The protection of the customer's personal data is important to Golfers Paradise.Further information on how Golfers Paradise handles data can be found in the privacy policy of Golfers Paradise.

 

11. Liability

Golfers Paradise excludes liability to the extent permitted by law for all direct (or immediate) and indirect (or consequential) damages resulting from the use of the online shop or in the context of goods orders or contract conclusions via the online shop. In particular, Golfers Paradise excludes any liability for slight and moderate negligence. Golfers Paradise also assumes no contractual or non-contractual liability for damages caused by auxiliary persons involved in the provision of services.

 

12. Applicable Law / Jurisdiction

All legal relationships between the customer and Golfers Paradise are subject to Swiss law.

The place of jurisdiction for disputes arising from or in connection with the legal relationships between Golfers Paradise and the customer is the headquarters of Golfers Paradise.

 

13. Severability Clause

If individual provisions of the GTC are or become invalid or ineffective, or if the GTC have an unforeseen gap, the effectiveness of the remaining provisions and the GTC as a whole remains unaffected. In place of invalid or missing provisions, the dispositive statutory law applies.
